Governing Documents

Our property owners association has three types of governing documents that are legally binding on all homes within the community:
Covenants, Conditions & Restrictions (CC&Rs)

The Declaration of Covenants, Conditions, and Restrictions (CC&Rs) states the division of power and the rights and responsibilities between the POA and its members. CC&Rs usually contain provisions related to the assessment obligations of its members, association and member maintenance responsibilities, architectural control powers, association enforcement authority, dispute resolution, property use restrictions, and insurance requirements.

Amending the CC&Rs, in most cases, requires a vote by the membership.

Bylaws

The Bylaws are terms that define how the POA is going to function as a corporation. Bylaws can name who will direct certain aspects of the POAs’ responsibilities. Bylaws will determine the number of directors, the frequency of elections, and any other procedures that are specific to the POA.

The provisions in the bylaws override only those in the operating rules in case of conflict. Aside from the operating rules, all the other governing documents precede the bylaws.

Rules and Regulations (R&Rs)

All homeowners and residents benefit from the planning and design that have been an essential part of the development of our
community.

Design controls aim to ensure homeowners and residents that design quality standards will be maintained. Which, in turn, protects
property values and enhances the community’s overall environment.

The Rules and Regulations (R&Rs) address amenity use, general rules and restrictions, exterior alterations, or modifications made by homeowners to their property (land and structures) as outlined in the Declaration of Covenants, Conditions, and Restrictions (CCRs) and By-Laws.

The authority for maintaining the quality of design in the community is founded in the Declaration of Covenants, Conditions and
Restrictions, and Association By-Laws, which are a part of the deed to every property. The Covenants establish the Architectural
Control Committee.

The Board of Directors may amend, repeal, and adopt these Rules and Regulations from time to time.
